Do Longview Contractors Need Workers’ Compensation?

Self-employed Longview contractors should review workers’ compensation based on their business structure, employees, and project contracts. Texas does not require it for most private employers, but government-project rules and contractor agreements can require coverage. Working alone does not settle every coverage or eligibility question.

Check the job’s requirements before you start

Ask the general contractor or customer for the insurance requirements in writing. A project may call for workers’ compensation even when state law does not generally require your business to buy it. Private employers working under government contracts must provide coverage for employees on those projects.

Send the requirement to the agency with the project description and start date. An insurance certificate does not add coverage or satisfy a missing endorsement.

Working alone, hiring help, and subcontracting

A sole proprietor without employees, an incorporated owner, and a contractor with employees may have different eligibility and owner-inclusion questions. TDI notes that some insurers offer coverage for executive officers even without other employees. Describe your actual structure before assuming a policy is available or covers you personally.

If you hire helpers or use subcontractors, explain who does the work and who controls it. A 1099 form alone does not resolve employee status for workers’ compensation. Review subcontractor coverage and any agreements before the job begins.

Compare the policies by what they do

Workers’ compensation insurance concerns covered work-related employee injuries and illnesses. General liability insurance addresses different liability exposures and should not be assumed to replace workers’ compensation. Occupational accident plans are also different products.
